Speaking to Fox News Digital, Comer argued that the presidential pardon granted by former President Joe Biden does not give Fauci blanket protection for anything he says during this week’s hearing. According to Comer, the pardon covers Fauci’s government service from 2014 through the end of Biden’s presidency but does not extend to any new testimony he provides before Congress.
“The pardon doesn’t cover Dr. Fauci’s testimony this week,” Comer said. “If he continues to lie, he must be held accountable.”
Comer maintained that while Biden’s pardon broadly shields Fauci from potential federal prosecution related to actions taken during his years of government service, it would not protect him from the legal consequences of making false statements during a congressional hearing. Under federal law, knowingly providing false testimony to Congress can carry criminal penalties, regardless of previous pardons for unrelated conduct.
